ATLM Design Ltd products are sold in the Mithio online store at www.mithio.com.

1.1. The Terms and Conditions apply to the legal relationship between the owner of ATLM Design Ltd (hereinafter “Seller”) at Valguse 5, 11621 Tallinn, Estonia, firstname.lastname@example.org and the person who made the purchase (hereinafter “Buyer”) in the environment of the www.mithio.com online store.
1.2. In addition to these terms and conditions, the legal relations arising from the purchase of products through the online store are regulated by the laws in force in the Republic of Estonia.
1.3. The seller may change the general terms and conditions of the online store and the prices of the products. The terms and prices valid at the time of the transaction are applied to the transaction
2.1. The presented prices include 20% VAT valid in the Republic of Estonia.
2.2. The price of the products is supplemented by the delivery method chosen during the ordering process and, depending on the delivery method, the handling fee (except for Smartpost and Omniva parcel machine services in Estonia). The delivery method is selected and the delivery fee is calculated in the shopping cart.
- PLACING AN ORDER
3.1. The product is added to the shopping cart after clicking the “Add to Cart” button on the product page.
3.2. It is possible to remove products from the shopping cart.
3.3. To place an order, click the “Pay” button in the shopping cart – the customer will be redirected to the ordering and payment page.
3.4. The order is considered completed after payment. In the Mithio online store, you can pay via Swedbank’s bank link, bank transfer or credit card.
3.5. After payment, an order confirmation will be sent to the Buyer’s e-mail.4.PAYMENT
4.1. Orders placed online are paid 100% in advance.
4.2. The buyer can use Swedbank’s bank link, bank transfer or credit card to payment.
4.3. Payment is made outside the online store in a secure environment – when paying with a bank link in the secure environment of the respective bank, when paying with a credit card in a secure environment on EveryPay (http://www.every-pay.com). The seller does not have access to the customer’s bank and credit card details.
4.4. After submitting and paying for the order, an order confirmation will be sent to the Buyer by e-mail, and an invoice will be added to the shipment upon delivery of the goods.
5. DELIVERY OF PRODUCTS
5.1. Mithio online store delivers goods as a standard service within Estonia. We also deliver goods to other countries in the world.
5.2. The products are delivered to the Buyer within Estonia free of charge with the Itella Smartpost and Omniva parcel machine service.The route of the shipment can be tracked on the basis of a barcode in the environment www.smartpost.ee or www.omniva.ee, if the buyer wishes to be notified of the parcel barcode to the e-mail address after placing the order. If you wish to receive a barcode, please notify about it in the additional comments box before confirming the order.
5.3. The products will be delivered to the Buyer within Estonia for a delivery fee, if a delivery method other than Itella Smartpost or Omniva is chosen.
5.4. We also deliver orders outside Estonia on the basis of the Buyer’s request and the price offer agreement, if the ordering environment does not provide the desired parcel delivery destination.
5.5. Orders are usually processed and posted within 3-4 working days after payment is received in our account. Delivery of the order depends on the postal services. Approximate arrival times in Estonia are 3-5 working days.
6. RETURN OF PRODUCTS AND CANCELLATION OF ORDER
6.1. The buyer has the right to withdraw from the transaction within 14 calendar days after receipt of the goods (except in case of defects in the product, see sub-clause “Warranty”). In order to return the products, the Buyer must fill in the return form included with the invoice /order and return the shipment to the Seller (return data is given on the invoice).
6.2. The Buyer is obliged to return the product to the Merchant within 14 days as of the submission of the return application. The return code of the Omniva and Smartpost parcel machine is valid for 14 days from the receipt of the parcel.
6.3. The terms for returning the product is an unused product with all labels attached and correct packaging. Returns will only be accepted with the filled return form.
6.4. The postage costs for returning the product shall be paid by the Seller if the product has been sent to the Customer using the Smartpost or Omniva parcel machine service.
7.1. The Seller shall be liable for non-compliance and defects of the products within 1 year from the delivery of the products to the Buyer.
7.2. If the product is found to be non-compliant or defective, please notify the Seller immediately.
7.3. The prerequisite for returning the product is an invoice issued to the Buyer.
7.4. In case of non-conformity or defect of the product, the Buyer has the right to demand the replacement of the product with a product that complies with the requirements and is free of defects, or to return the product at the Buyer’s expense.
7.5. In case of returning the non-compliant product, the amount paid for the product together with the transport cost will be reimbursed to the bank account indicated by the Buyer no later than within 14 days from the return of the product to ATLM Design Ltd.
7.6. The seller is not liable for non-conformity or defects of the product if:
7.6.1. The product has deteriorated / damaged due to the Buyer’s fault;
7.6.2. Disadvantages have arisen from the misuse of the product, i.e. as a result of non-compliance with the maintenance instructions;
7.6.3. The product has changed due to natural wear and tear during normal use.
8. OTHER CONDITIONS
8.1. The data stored in the online store’s ordering environment about the Buyer and his orders is treated as confidential information. The buyer does not disclose the data that has come to his knowledge to third parties.
8.2. The data communication between the Buyer and the banks and the card payment center is encrypted, which ensures the security of the Buyer’s personal data and bank details. The seller does not have access to the customer’s confidential bank and payment card details.
8.3. Disputes between the Buyer and the Seller shall be resolved through negotiations. The Seller shall respond to the Buyer’s complaints and claims by e-mail within 5 working days at the latest. In case of failure to reach an agreement, the Buyer has the right to apply to the Consumer Protection Board or Harju County Court to protect his rights. Disputes shall be resolved in accordance with the laws of the Republic of Estonia.
